Under the provisions of the Building Act 2016, Councils are responsible for taking enforcement action against properties and owners where illegal (i.e. without a permit) building works have been done.
Where we become aware that a property has building works without approval, we are required to take action in accordance with the Building Act 2016. This action may result in fines, the demolition of the building work or having to seek retrospective approval.
If you believe that your property has some unapproved building works, you are encouraged to contact our building officers to discuss your options for getting approval.
Please note: it is common for illegal building works to prevent or hinder the sale of a property.
In conjunction with illegal building works, we have the power to issue infringement notices for certain breaches of the Building Act 2016 and Building Regulations 2016.
These infringement notices are issued at our discretion and can be served on an owner, a company or a building practitioner.
