Right to information

As a public authority, Council is required to comply with the provisions of the Right to Information Act 2000 (external link).

The RTI Act gives members of the public the right to obtain information about the operations of Government in certain circumstances.

Under the RTI Act, you have a legal right to be provided with information in the possession of a public authority, unless the information is exempt information.

Accessing information

The RTI Act requires Council to make certain information available through active disclosure. This means that Council will routinely make information available which will assist the public in understanding what Council does and how we do it.

Council primarily provides information about its operations through this website. That information may include publications such as information sheets, by-laws, the minutes of Council meetings and Council’s Annual Report. Council also regularly publishes information in the Glenorchy Gazette, which can be accessed online or in hard copy at Council’s chambers.

If you are unable to find the information that you are seeking on our website, please contact us as we may be able to assist you by providing the information, or by helping you to make an application for assessed disclosure (see below).

Applications for assessed disclosure

Some information is not actively disclosed by Council, either because it is not in the public interest to make it available, or because it may be exempt information under the RTI Act and Council needs to conduct an assessment against the exemptions to determine whether we are required to release it.

If the information you have requested falls into that category, you may make an application for assessed disclosure to Council. We encourage you to make applications at our Customer Service Centre or using Council’s Application for Assessed Disclosure Form (PDF).

You can also make your application in writing without completing Council’s application form, however your application must include the information set out regulation 4 of the Right to Information Regulations 2010  (external link).

Assessment process

After determining whether your application has been made correctly and contains the required information (during which we may contact you), Council’s Right to Information Officer will assess your application against the provisions of the RTI Act.

Council will advise you in writing of the outcome of the assessment process within the following timeframes:

  • 20 working days for an ordinary application
  • 40 working days where we need to consult with a third party.

If your application will take more than 20 working days to assess, either because we are consulting with a third party or because it is for a complex or large amount of information, we will notify you in writing and provide a revised date for the outcome of the assessment.

Refusal of application if the Council determines that all or part of the application is refused, we are required to:

  • notify you of the refusal
  • provide written reasons for refusing to provide the information
  • provide you with details of your right to seek a review of our decision.

Please note that the RTI Act sets strict time limits for the making of a request for a review. The timeframes are set out in section 43 of the RTI Act site (external link).

You should ensure that you submit any request within those timeframes, otherwise we may refuse to accept it.

Review by Ombudsman

If you are not satisfied with the outcome a review of a decision, you can, in certain circumstances, apply to the Office of the Ombudsman for a further review.
