Council supports businesses trading on public footpaths, while ensuring footpaths remain safe, accessible, and convenient for everyone.
All footpath trading must comply with the Footpath Trading Policy and Guidelines.
Where Can Trading Occur?
Trading must be set up near the kerb — not against the building line. This keeps the building line clear for people with visual disabilities to navigate safely, while leaving adequate space for pedestrians, wheelchairs, mobility scooters, and prams.

What is footpath trading?
Footpath trading involves the use of public footpaths adjacent to a business for commercial purposes, including:
- Outdoor dining areas and footpath cafés
- Tables and chairs
- A-frame signs
- Merchandise displays
- Other approved business-related activities
Why you need a permit
Public footpaths are shared community spaces. A permit helps ensure that footpath trading activities:
- Maintain safe and accessible pedestrian access.
- Meet Council standards for safety, amenity and presentation.
- Minimise impacts on neighbouring businesses, residents and public infrastructure.
- Support accessible movement for people of all abilities.
What Types of Trading are Permitted?
- Outside dining — tables and chairs on the footpath
- Sale of goods — outdoor tables with products for sale
- Portable signage — A-frame signs for business advertising
A permit is required for outside dining and sale of goods. Portable signage does not require a permit but must still comply with the policy.
Permit conditions
Permit approvals may include conditions relating to:
- Approved trading areas and operating hours
- Minimum pedestrian clearances and accessibility requirements
- Furniture standards and maintenance obligations
- Public liability insurance requirements
- Safety and operational considerations
Council generally requires a clear pedestrian accessway of at least 1.5 metres to be maintained at all times.

How to Apply
To apply for a footpath trading permit, complete the Footpath Trading Application form available on Council’s Forms page and submit it with the applicable fee.
Applications must include:
- A site plan showing the proposed footpath trading area
- Details of furniture, equipment or displays to be used
- Any other supporting information requested by Council
- Read the Policy and Guidelines — Familiarise yourself with the Footpath Trading Policy and Guidelines before applying.
- Complete an Application — Submit the Outside Dining and Sale of Goods application form to Council via email or our Service Centre. (Portable signage only? Skip this step.)
- Wait for a Decision — A Council officer will be in touch, and may request additional information. If approved, you’ll receive a permit and payment request. There is no application fee.
