How to object to a planning application - and what to do if you want to appeal.

Making a representation (objection)

When a planning application is advertised, anyone can view the proposed plans and formally submit a representation (objection or support) during the advertising period.

Submissions can be made by letter to the General Manager at PO Box 103, Glenorchy TAS 7010, or by email to gccmail@gcc.tas.gov.au. You can also download the representation form.

Deadlines: Online and email submissions must be received by 11:59pm on the final day. Postal and hand-delivered submissions must arrive by 5:00pm.

Making an appeal

You can appeal a council decision if you are either the original applicant, or someone who lodged a representation during the advertising period.

As an objector, you have 14 days from the date of council’s decision to lodge an appeal if a permit is granted.

As an applicant, you can appeal against a refusal or against conditions attached to an approved permit.

Appeals are handled by the Tasmanian Civil and Administrative Tribunal (TASCAT) and are lodged by submitting a Notice of Appeal form and paying the required fee.

The appeal process:

  1. A directions hearing is held first, where the Registrar explains the process, ensures all parties have the information they need, explores whether mediation is possible, and sets dates for any further hearings.
  2. If mediation doesn’t resolve the matter, a full hearing is held where formal submissions are made and the Tribunal issues a legally binding decision.

Note: If the applicant appeals, TASCAT won’t notify you directly — check the Public Notices section of The Mercury (Wednesdays and Saturdays) or contact the Tribunal. If you want to be involved in the applicant’s appeal, apply in writing to be “joined as a party” and attend the Directions Hearing.

Important: A granted planning permit doesn’t take effect until the 14-day appeal period has passed — and if an appeal is lodged, the permit remains on hold until the appeal is resolved or withdrawn.
